What action can I take against a Dos Attacker?

For months now my website has been under a dreadful amount of Dos Attacks. I have the IP address of the person doing it, but they live in a different continent. What action can I take to ensure that he or she is punished? Would it be too much of a hassle to take legal action against him or her? What are some other options?
